Terms of Service

By downloading, installing, or using BySide, you agree to these Terms of Service. Please read them carefully before using the app.

1. Acceptance of Terms

These Terms form a binding agreement between you and BySide (operated by a sole developer based in Finland). If you do not agree to these Terms, do not use the app. Your continued use of BySide after any updates to these Terms constitutes acceptance of the revised Terms.

2. Nature of the Service

BySide is a personal safety tool designed to help you share your live location with trusted contacts and send emergency alerts. It is intended to aid situational awareness and help your trusted circle respond when you need support.

3. Eligibility

You must be at least 13 years old to use BySide. By using the app, you confirm you meet this requirement. Users under 18 should use BySide with the knowledge and consent of a parent or guardian.

4. Your Use of the App

BySide does not require you to create an account or set a password. You are responsible for your use of the app and for keeping your device secure. If you believe someone has gained unauthorised access to your device and your BySide data, contact us at support.byside@gmail.com.

5. User Responsibilities

You agree to use BySide only for lawful, responsible purposes. You must not:

• Use BySide to track, monitor, or surveil another person without their explicit knowledge and consent.
• Share false or fabricated emergency alerts with the intent to alarm others.
• Use location sharing in violation of any applicable law or regulation.
• Attempt to reverse engineer, interfere with, or disrupt the service or its infrastructure.
• Use the service in any way that could endanger or harm others.

You are solely responsible for how you use location sharing and for ensuring you have the legal right to share your own location in your jurisdiction.

6. Location Sharing

Location sharing is always voluntary and always initiated by you. You control who receives your location link and when a session starts or ends. BySide does not share your location with anyone you have not explicitly chosen.

Only share your location with people you genuinely trust. Do not share your BySide session link publicly.

7. Emergency Features

BySide's alarm and emergency alert features are supplementary safety tools. They notify your Trusted Contacts, but BySide cannot guarantee that alerts will be received, seen, or acted upon in time. These features do not connect you to emergency services and are not monitored by any response centre.

Always contact official emergency services (112 / 911) in a life-threatening emergency.

8. Subscription and Payments

BySide offers a free tier with a monthly allocation of live location sharing. A Premium plan with extended features is planned for a future release. Pricing and subscription terms will be communicated clearly before any charge is made. All purchases are subject to Apple's App Store terms and refund policies.

9. Service Availability

We aim to keep BySide available at all times, but we cannot guarantee uninterrupted service. The app may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. BySide requires an active internet connection for live location sharing and emergency messaging.

10. Termination and Changes

We reserve the right to modify, suspend, or discontinue any feature or aspect of BySide at any time, with or without notice. We may also terminate or restrict access to your account if you violate these Terms.

You may stop using BySide at any time and delete your account via the app or by contacting support.

11. Intellectual Property

All content, design, branding, and code in BySide are owned by BySide. You may not copy, modify, or distribute any part of the app without written permission.

12. Disclaimer of Warranties

BySide is provided "as is" and "as available" without warranties of any kind, express or implied. We make no warranty that the service will be error-free, uninterrupted, or suitable for any particular purpose.

13. Limitation of Liability

To the maximum extent permitted by applicable law, BySide and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the service, including any failure of an emergency alert to be received or acted upon.

14. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising under these Terms shall be resolved in Finnish courts, unless mandatory consumer protection law in your country requires otherwise.
